What to Do if You Get Injured

If you have been injured at work you should do the following:

Seek immediate medical attention!

If your doctor prescribes any work restrictions you should obtain them in writing, provide a copy to your employer, and keep a copy for yourself.

Report your injury to your employer.

This can be done by telling your supervisor, or other person in charge.  Also, if you cannot find your supervisor or other person in charge, you can report your injury by telling a someone in the Human Resources Department of your company.

Make sure you write down the name of the person you told, the date and time you told them and what you may have told them about your injury.  Your employer should provide you with a claim form (Form 45). If they do not voluntarily give you a form, you should ask for one.

Fill out the form and hand deliver it to your employer as soon as possible.  If you cannot hand deliver it, you should send it by certified mail.

Seek the advice of an experienced workers' compensation attorney.

Remember, not all attorneys know how to handle a workers' compensation claim. Finding the right attorney will be important to you in obtaining all the benefits to which you are entitled.
